Welcome to StableVPS. Please read these Terms of Service (“Terms,” “Agreement”) carefully before accessing or using the website https://stablevps.io (the “Site”) and the virtual private server infrastructure provided by StableVPS (“we,” “us,” or “our”).

By establishing an account, submitting a payment, or deploying a Virtual Private Server (VPS), you agree to be bound by these Terms. If you do not agree to all terms within this document, you are strictly prohibited from using our services.

1. Eligibility and Account Security

Age Restriction: You must be at least eighteen (18) years of age to register an account or use our infrastructure. By signing up, you warrant that you possess the legal capacity to enter into a binding contract.

Account Custody: You are entirely responsible for maintaining the confidentiality of your Client Area credentials, Remote Desktop Protocol (RDP) passwords, and API keys. You assume full legal liability for all activities, code execution, and data transmissions originating from your provisioned server instances.

2. Infrastructure Deployment and Subscription Terms

Reseller Cloud Framework: StableVPS operates as an automated infrastructure deployment platform utilizing wholesale upstream cloud provider networks. Services are delivered on an "as-available" baseline.

Automated Billing & Renewals: All Services are billed on a recurring monthly or annual subscription basis via Stripe. Subscriptions automatically renew at the end of each billing cycle unless explicitly canceled inside your Client Area at least twenty-four (24) hours prior to the renewal date.

Suspension and Data Purge: If a recurring payment fails, your VPS instance will be automatically suspended. If an account remains unpaid or suspended for fourteen (14) consecutive calendar days, StableVPS reserves the right to permanently delete and purge the virtual machine disk image, including all hosted data, trading bot configurations, and historical logs, with zero liability for data loss.

3. Strict Automated Bot & Trading Software Liability Disclaimer

StableVPS provides clean, unmanaged, unconfigured Windows Server environments optimized for low-latency network connections.

No Financial Liability: You explicitly acknowledge that StableVPS does not build, own, test, or maintain your trading bots, Expert Advisors (EAs), scripts, or algorithmic execution code.

The User's Risk: You run automated trading software entirely at your own financial risk. StableVPS carries absolute zero financial liability for monetary losses, missed execution windows, broken API webhooks, trading platform crashes, slippage, or account liquidation triggered by your software setups.

No Financial Advice: No content, technical documentation, or support ticket response provided by StableVPS constitutes financial, legal, or investment advice.

4. Acceptable Use Policy (AUP) and Infrastructure Abuse

You are strictly prohibited from using our virtual infrastructure to engage in malicious, disruptive, or illegal network activities. Forbidden actions include, but are not limited to:

Running outbound Distributed Denial of Service (DDoS) attacks, network scanning, port probing, or packet sniffing.

Deploying unauthorized crypto-currency mining scripts that cause persistent, artificial hardware resource exhaustion on shared host nodes.

Hosting, distributing, or transmitting malware, trojans, ransomware, or botnet command-and-control software.

Sending unsolicited bulk commercial messages (Spam) or setting up unauthorized open mail relays.

Utilizing our Windows environments to bypass copyright laws, host pirated material, or distribute illegal content.

StableVPS implements automated behavioral telemetry to detect system abuse. Any server instance found in direct violation of this Acceptable Use Policy will be instantly terminated without notice and without a refund.

5. Limitation of Liability and Uptime Commitments

As-Is Baseline: Our cloud infrastructure is provided on an "as-is" and "as-available" basis. While we strive to achieve a 99.9% network uptime margin, StableVPS makes no explicit guarantees regarding uninterrupted operational continuity.

Upstream Force Majeure: StableVPS relies on third-party data center facilities and backbone internet routing networks. We cannot be held liable for server downtime, data packet drops, RDP connection failures, or hardware degradation caused by upstream outages or localized infrastructure failures.

Liability Cap: To the maximum extent permitted by applicable law, the cumulative aggregate liability of StableVPS for any legal claims, service drops, or performance failures shall never exceed the total dollar amount paid by you to StableVPS for the specific server instance during the thirty (30) days immediately preceding the event triggering the claim.

6. Indemnification

You agree to indemnify, defend, and hold harmless StableVPS, its parent operators, affiliates, contractors, and employees from and against any third-party claims, lawsuits, financial losses, regulatory fines, damages, or legal expenses (including attorney fees) arising from:

Your misuse of our virtual servers.

The commercial or operational behavior of your automated trading bots and algorithms.

Any data breaches or intellectual property violations tied to software running inside your provisioned virtual machines.

7. Governing Law and Dispute Resolution

These Terms and all legal relationships arising from them shall be governed by, and interpreted in accordance with, the laws of the European Union framework / [Insert Country of Incorporation, e.g., Lithuania or Germany], without giving effect to any principles of conflicts of law. Any formal legal actions or structural disputes tied to this contract shall be submitted exclusively to the jurisdiction of the competent courts in your region of incorporation.

8. Severability and Complete Agreement

If any provision within these Terms is found to be unlawful, void, or legally unenforceable by a court of competent jurisdiction, that specific provision shall be severed from the contract, and its removal shall not impact the validity and enforceability of the remaining terms. This document constitutes the entire legal agreement between you and StableVPS regarding infrastructure use.
